Terms of Service & Acceptable Use

1. Introduction & Acceptance of Terms

These Terms of Service ("Terms", "Agreement") govern your access to and use of ProxyVault ("we", "us", "our"), accessible at proxyvaultng.com.ng (and related domains) and our APIs, software, and services (collectively, the "Services").

By creating an account, depositing funds, renting residential ISP proxies, or obtaining virtual SMS numbers, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Services.

2. Nature of Services Provided

ProxyVault is a professional digital infrastructure platform providing:

• Static Residential ISP Proxies: Dedicated, high-speed HTTP, SOCKS5, and WireGuard tunneling allocated from tier-1 carriers (Comcast, AT&T, Verizon, Lumen, etc.) for scraping, multi-account management, ad verification, and private browsing.
• Virtual SMS Phone Numbers (OTP Activations): Temporary disposable and rental numbers for receiving SMS verification codes across global web services (WhatsApp, Telegram, Google, Claude, OpenAI, etc.).
• Prepaid Naira Wallet: In-app digital balance denominated in Nigerian Naira (NGN) funded via licensed payment gateways (Korapay).

3. User Account Security & Authentication

• You must provide a valid email address and maintain a strong password.
• You are solely responsible for all activities occurring under your account and for safeguarding any proxy credentials (login, password, WireGuard configs) or API tokens issued to you.
• ProxyVault accounts are non-transferable. You may not sell, trade, or share your account credentials with unauthorized third parties.

4. Acceptable Use Policy (Strictly Enforced)

ProxyVault provides high-trust, legitimate network infrastructure for business professionals, digital marketers, software developers, and research analysts. You agree NOT to use our proxies or SMS numbers for any of the following prohibited activities:

1. Cyberattacks & Exploitation: Distributed Denial of Service (DDoS), port scanning, network brute-forcing, SQL injection, vulnerability probing, or botnet command-and-control operations.
2. Financial Fraud & Stolen Credentials: Carding, credential stuffing, accessing unauthorized bank accounts, chargeback fraud, or laundering unauthorized transactions.
3. Spam & Phishing: Unsolicited mass marketing (email/SMS/social spam), fake login pages, impersonation of financial institutions, or social engineering campaigns.
4. Copyright Infringement & Torrenting: Torrenting via public peer-to-peer (P2P) trackers, unauthorized distribution of protected copyrighted media, or bypass of DRM protection.
5. Illegal Content: Transmitting, distributing, or facilitating access to child sexual abuse material (CSAM), violent extremism, terrorist propaganda, or unlawful narcotics trading.

Zero-Tolerance Penalty: Any account detected violating this Acceptable Use Policy will face immediate, permanent termination, revocation of all active leases, and forfeiture of wallet balance without prior notice. Serious infractions will be reported to competent law enforcement agencies.

5. Replacement, Refund & Liveness Reconciler Policy

We take pride in our automated upstream liveness verification engine. Our refund and replacement policies are structured as follows:

• Proxy Replacement Window (24 Hours): If an allocated proxy experiences connectivity degradation, carrier blacklisting, or port unreachability within 24 hours of lease allocation, you may request a free automated replacement from your dashboard.
• Automated Upstream Liveness Reconciler: If an upstream carrier revokes an allocated IP or if an allocation cannot be fulfilled, our automated reconciler detects the discrepancy, releases the lease, and credits ₦7,500 back into your ProxyVault wallet balance immediately.
• SMS OTP Policy: Virtual SMS numbers are charged upon successful delivery of the verification code. If no SMS arrives within the timeout window, the transaction is automatically cancelled and zero balance is deducted. Delivered SMS codes cannot be refunded once received.

6. Intellectual Property & Service Availability

The visual design, brand assets, dashboard software, APIs, and documentation are the exclusive intellectual property of ProxyVault. We strive for 99.9% uptime across our nodes; however, you acknowledge that internet infrastructure depends on upstream international carriers and datacenters. We provide the service on an "AS IS" and "AS AVAILABLE" basis.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ProxyVault, its operators, affiliates, and suppliers shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, data, or account suspensions on third-party websites accessed through our proxies.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without giving effect to any principles of conflicts of law. Any disputes arising out of or related to these Terms shall be resolved through good-faith negotiation or arbitration in accordance with the Arbitration and Mediation Act.
